Terms & Conditions

All customers (hereinafter referred to as "Client") of Sara*s Pixel Studio (hereinafter referred to as "SPS") are legally bound by the following terms and conditions regarding any service or item that the Client purchases from SPS.

Payments

Payment is due before services are rendered. One hundred (100) percent of all design fees and item costs are due upfront.

We accept Visa, MasterCard, Discover, American Express, PayPal, check or USPS money order. All payments must be verified and/or cleared before services or items will be rendered. If you choose to pay by check or Money Order please make payable to and mail to:

Credit card charges will appear on the Clients credit card statement from Saras Pixel Studio.

Shipping

All digital items will be delievered electronically and there is no shipping charge.

Shipping costs for printed materials will be determined by order amount and shipping address. SPS will notify the Client of the shipping costs once the order has been accepted. Shipping charges are then due and must be paid before the order is placed with the printer. SPS cannot ship printed materials to PO Boxes.

If the original invoice was paid via PayPal SPS will send a 2nd invoice to the Client's PayPal address in the amount of the shipping charges.

If the original invoice was paid via Visa or MasterCard SPS will ask the Client to authorize an additional charge on the credit card in the amount of the shipping charges.

If the Client is paying by check or money order they must include the shipping amount with the original invoice amount on one check or money order.

Copyrights & Trademarks

The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to SPS for inclusion in the design project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend SPS from any liability (including attorney's fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Client.

Design Copyright & Use

If the design project is one hundred percent custom work, one of a kind and made only for the Client, copyright to the finished design project produced by SPS will be owned by the Client. Ownership of these copyrights may never be sold or transferred in any way. The Client will only be assigned these rights after all fees incurred in the design process have been paid. Failure to pay due moneys will result in the project design being revoked and appropriate legal action to acquire remaining balance.

SPS retains the right to display graphics and other design elements as examples of our work in our respective portfolios.

If the design project is not 100 percent custom work and contains any pre-made graphics, HTML or other elements, copyright to the finished design project remains forever owned by SPS. The Client will be assigned rights to use the project for its intended purpose. The project may not be altered, sold, given or transferred in any way.

In either instance the live link to the SPS website and design credit byline may not be removed from any project for any reason. (Website Design Only)

Errors & Omissions

It is the Client’s responsibility to check proofs carefully for accuracy in all respects, ranging from spelling to technical illustrations. SPS is not liable for errors or omissions. The Client's approval (digital or physical) is required on all elements or artwork prior to release for printing or other implementation.

Cancellations, Refunds and Returns

Website Design

The SPS design process is rigorous and we usually begin every project within twenty-four (24) hours of receiving the order and payment. Work typically flows very fast and the process moves along quickly. Due to this rigorous schedule our cancellation/refund policy is as follows:

The Client has seventy-two (72) hours to cancel their order and request a refund. If work has been started on the project the refund will be prorated to cover work already completed at the rate of $35 per hour. After seventy-two (72) hours no refund will be issued.

If the design project is one hundred percent custom work, one of a kind and made only for the Client, the completed parts of the project will be delivered to the Client. Image files will be presented as editable Photoshop or Illustrator files. HTML, CSS or scripts will be presented as .txt files.

If the design project is not 100 percent custom work and contains any pre-made graphics, HTML or other elements, no work will be delivered to the Client.

All Client-owned and/or provided items will be returned within 24 hours of cancellation.

Pre-Made Templates

Cancellations or refund requests will only be processed for pre-made templates if the template has not already been customized for the Client (if we have already processed your order).

Printed Materials

We cannot accept cancellations on printed items once shipping amount has been charged. We will issue refunds for defective or erroneous printed materials on a case-by-case basis and only if the mistake is the fault of the printer. Artwork correctness and usability is the responsibility of the Client.

Other Add-ons & Edits

Items marked "Website Design Upgrade" are not eligible for refunds. Please only purchase these items if you need them.

All other add-ons and edits can be refunded as long as they have not been started as part of the project. (i.e. Client purchases 4 content pages but ends up only needing 3, SPS will refund the extra page price)
